Heavenly Views Executive Village. O diba?

Fucked up sa buong mundo! Mga fucked up!

Ayon sa kaibigan kong Sabahan - "No, the Sabahans are united in that. They do not want Sulu domination, nor Philippine domination for that matter. They would rather be their own independent country."

Dagdag pa niya, "If they had to choose between Philippines and Malaysia, they would pick Malaysia, not entirely for economic reasons but because the Philippine government is just simply so backwards, they are fully aware of the religious and ethnic issues in the Philippines, they dont want any part of that."

Fuck you Philippines. Now, fuck off!

    2. Kailan ba naging opposed ang Sabahans? Please enlighten us here oh all knowing one.

Was there ever a referendum held about the Philippines Sabah claim?

Has the ICJ ever decided on this?

Was there ever a case filed before the ICJ?

Was there ever a decision made by the ICJ based on the basis of SELF-DETERMINATION alone?

      I'm waiting.....

my point? if ever there are sabahans going online to say good things about sabah and bad things about the philippines most likely they are paid hacks of the malaysian government.

Malaysian and Philippine governments had it coming, Malaysia for land grabbing Sabah from the Sultanate of Sulu and the Philippines for colonizing Mindanao in 1935 when in fact MINDANAO, SULU and PALAWAN were sovereign states with respective Sultans.

hahahaha Spratlys and Sabah claim my ass, respect the BANGSAMORO claim first.

  2. know your history you dumbass, in 1962 the heirs of the Sultan of Sulu granted the Philippine government full authority to pursue the claim legally.

also if you weren't such a filipino hater you would probably realize that there is more than meets the eye behind long standing allegations that the MNLF, MILF, etc. and every other Muslim separatist group in Mindanao has long been supported by the Malaysian government in order to distract the Philippine government from claiming Sabah.

personally i'd rather we still lease Sabah to the Malaysians but at a higher rent, 5,300 ringgit is just P74,200, that's nothing. Let the Malaysians pay 500 million ringgit a year + 20% of whatever revenue they get from oil and Sabah's other natural resources.

    2. From the history books...
As reported by the Secretary-General of the United Nations, the independence of North Borneo was brought about as the result of the expressed wish of the majority of the people of the territory in a 1963 election.

This is further reinforced by the International Court of Justice view that,
“ ...historic title, no matter how persuasively claimed on the basis of old legal instruments and exercises of authority, cannot - except in the most extraordinary circumstances - prevail in law over the rights of non-self-governing people to claim independence and establish their sovereignty through the exercise of bona fide self-determination."

We know our history very well, but do you know Sabah's history as well? Malaysia however, considered this dispute as a "non-issue", as there is no desire from the actual people of Sabah to be part of the Philippines or of the Sultanate of Sulu.

That lease is as ancient as the fossils that died eons ago, we can't even manage our own country well, horrible politics and a mismanaged anemic economy, and yet we want to take over that patch of land that has been granted with their own independence and self-determination? If the Philippines wants some kind of war with other nations then I'm not willing to die for such bullshit like that. The lease is just fine, leave it as it is, stop claiming other lands when you can't even manage your own.

Also, about the Sabah claim, the President didn't even give a damn when he came to as president in his early years, the letter that was written by the Sultan of Sulu was supposed to have reached him but disappeared, it was only until now that he started caring about this..must be the fiesta election mood.

we have never lost our claim on Sabah, legally may basis tayo, what we don't have is a president who has the balls to actually do something about it and a military force to back us up. ganun lang kasimple iyun.

first of all the International Court of Justice has not yet resolved the Philippines' Sabah claim. Have you conveniently forgotten that Malaysia refused to participate? What you cited is a mere opinion of an Ad Hoc British Judge in the case between Malaysia & Indonesia where the Philippines filed a third party intervention ; whom might be affected by the decision on the case. Ad hoc judges are not permanent magistrates of the International Court of Justice at the time of the disposition of the case. His view, albeit very controversial; is only one of the many opinions of the main judges and is irrelevant to the issue of the case at hand.

Besides, if self-determination is indeed the right of people who find themselves in such a situation then answer me this, was there a referendum among HK and Macanese people in 1997 when Britain's lease on HK and MACAU expired?

    11. As to your self-determination argument, nasa picture ba sa bawat isang tao na nasa Sabah noong 1963 ang claim ng Pilipinas at ng Sulu nung ng-referendum sila? Wala. With this, the fact still exists that the Philippine claim over Sabah stands.

    13. North Borneo was never part of British territory and its people were never British subjects until July 10, 1946, or six days after Philippines independence, when Britain unlawfully "asserted full sovereign rights over" the island.

But "in accordance with established precedents in International Law, the assertion of sovereign rights by the British Crown in 1946, in complete disregard of the contract of 1878 and their solemn commitments did not and cannot produce legal results in the force of a new title," according to Salonga.

This even prompted former American Governor-General F.B. Harrison, then Special Adviser to the Philippine Government on Foreign Affairs, "to denounce the cession order as a unilateral set in violation of legal right."

    14. The International Court of Justice (ICJ) has not yet ruled on the conflicting territorial claims of the Philippines and Malaysia in relation to Sabah. Unlike in ordinary local courts, the ICJ generally takes cognizance of a dispute only if the contending parties willingly agree to bring the matter for resolution to the ICJ. Considering that Malaysia has consistently refused to give its consent, this never happened.

There was one time when the Philippines, confident of its claim and evidence, tried to indirectly submit the dispute to the ICJ. On March 13, 2001, the Philippines petitioned that it be allowed to intervene in the territorial dispute between Malaysia and Indonesia pending with the ICJ. This dispute involved the islands of Pulau Ligitan and Pulau Sipadan located in the Celebes sea, off the Northeast coast of the of the Island of Borneo. The Philippines asserted that any decision of the ICJ in the dispute might affect its claim on North Borneo, particularly Sabah. Malaysia and Indonesia objected on the ground that the Philippines had no legal interest in the case which did not involve North Borneo and therefore has no right to intervene.

Eventually, the ICJ proceeded to examine whether the Philippine claim of sovereignty over North Borneo, particularly Sabah, could or could not be affected by the territorial claims of Indonesia and Malaysia involving two different islands, namely Pulau Ligitan and Pulau Sipadan. In the end, the ICJ determined that there was no showing that the claim of the Philippines over North Borneo will be prejudiced at all by any resolution of the case between Malaysia and Indonesia. The petition of the Philippines to intervene was therefore denied. The ICJ , in effect, ruled that the issue between the Philippines and Malaysia over North Borneo was a DIFFERENT MATTER which must be threshed out in another case.

Unfortunately MALAYSIA doesn't want to be dragged in such a case because they know they will lose.

    15. In that 2001 case, following were the opinions of the different judges:

Judge Oda dissented and opined that the Philippines should have been allowed to intervene. He opined that a non-party should be allowed to intervene if he can show that he may be affected by any consequent ruling by the court involving other parties. Judge Oda said that a definitive showing that the Philippines at that point of the proceeding will be affected is unfair considering that the Philippines had no access to the pleadings of both Malaysia and Indonesia in the main case.

Judge Koroma reminded the court that whether the intervention was granted or not, it was not binding to a non-party to the case ( like the Philippines) pursuant to the ICJ Statutes.

Judge Parra-Aranguren opined that the only important part of the decision is the dispositive portion and stated that he could not agree to some paragraphs of the decision, saying that the Philippines’ legal interest may not be affected by the interpretation.

Judge Kooijmans stated that he agreed with the resolution but, if the ICJ wanted more specificity from the Philippines, it should have required the Philippines to do so.

Then two ad hoc judges also expressed their opinions: Weeramantry and Franck. Ad hoc judges are not permanent magistrates of the International Court of Justice at the time of the disposition of the case. They may have already retired as judges by the time the dispute was elevated to the ICJ, but by request of the main parties to the case, they have acted as ad hoc judges.

Under the Statutes of the ICJ, in the event that there are no judges in the ICJ belonging to the nationality of the contending parties, either party can seek the appointment of an ad hoc judge, not necessarily having its nationality. The parties in this case were Malaysia and Indonesia who objected to the entry of the Philippines. Either one of countires chose Judge ad hoc Franck or Judge ad hoc Weeramantry.

Judge ad hoc Weeramantry suggested that the case could have been an occasion to fully explain all the technicalities and ramification of an intervention proceeding in the ICJ .

Judge ad hoc Franck made the most controversial view as he opined that the Philippines’ assertion of historic title over North Borneo should not prevail over the doctrine of self-determination. It is his opinion that all claims of the Philippines are barred considering that the North Borneans have already decided that they want to be in Malaysia.

The quote made by some genius here was from an AD HOC Judge, not a FULL TIME judge at the ICJ. Worse, he made it appear that it was a quote that was directly tied-up to the Philippines's Sabah claim, maliciously trying to convince people here that such a decision was already made on the claim and that HISTORICAL TITLES are useless and have no basis.

    18. I have a better idea, why don't we all exercise our right of self-determination as cited by some genius here.

Let's just retain Manila and Visayas give away the rest of the Philippines for free!

Let's give the whole of Mindanao to Malaysia, anyway majority of the Muslim population of our poor country is in that area.

Then let's give away the whole of Luzon to China.

Then let's put all of the Visayan islands up for lease, don't tell me the Hiltons won't jump at the chance to take a lease on Boracay :)

      Let's go!

    21. There are two issues here,

First, the issue of whether or not the Philippines has a legitimate claim on Sabah, that is if a lease and historical title can stand. Given the example of HK and MACAU in 1997 - wherein the Brits returned the islands to CHINA after the lease expired - then we have a case.

Second issue is whether or not so called self-determination will trump over a historical claim. Again, if we are to use the HK and MACAU return as an example that doesn't seem to be the case since there was no referendum made among the HK and MACAU locals at that time as to whether or not they wanted to be part of CHINA or to be independent. On a personal note, I have many friends in HK who migrated to Canada between 1990-1995 simply because they didn't want to be part of CHINA.

I think no one argues about the first issue, that the Sultan of Sulu's claim is legit, its the second issue that muddles the discussions here. That is even if the ICJ awards Sabah back to us the Malaysians living in Sabah can dispute this with the self-determination card.

    25. The heirs of the Sultan of Sulu have waited for 50 years for the Philippine government to legally take back Sabah, that's what they did in 1962 when they gave the government full authority to go to the ICJ.

Thus it is unfair to say that the heirs of the Sultan of Sulu are being hardheaded about the matter when in fact it is the government's lukewarm stance on the matter that is really causing the trouble.

I say its about time we file a case with the ICJ - not simply because we want Sabah back - but for us to put an end to this Sabah claim saga once and for all.

    26. Article IV of the Malaysia Agreement of 1963 reads as follows:

The Government of the United Kingdom will take such steps as may be appropriate and available to them to secure the enactment by the Parliament of the United Kingdom of an Act providing for the relinquishment, as from Malaysia Day, of Her Britannic Majesty’s sovereignty and jurisdiction in respect of North Borneo, Sarawak and Singapore so that the said sovereignty and jurisdiction shall on such relinquishment vest in accordance with this Agreement and the constitutional instruments annexed to this Agreement.

Because it was stated that one part of Sabah belonged to the Brunei Sultanate and the other part to the Sulu Sultanate, and while Brunei had ceded her part of Sabah’s sovereignty, Sulu (now part of the Philippines) only leased her part of Sabah, does Her Britannic Majesty had sovereignty over the whole or only one part of Sabah?

It is obvious that the answer is only one part of Sabah, therefore Article IV is null and void thereby rendering the entire Malaysia Agreement of 1963 illegal and of no effect…!

There is a legal maxim “nemodat quod non habet” which means “you cannot give what you do not have”.

Legitimate and legal independence or autonomy for that one part of Sabah that was leased from the Sulu Sultanate can only come from the Philippines.

MINDANAO, SULU, PALAWAN and NORTH BORNEO is BANGSAMORO. The Moros were never part of the Philippines, they had their own homeland, when Philippine independence was granted via the Tydings McDuffie Act in 1935 the then Commonwealth lead by QUEZON instituted acts to colonize Mindanao which at that time was already sovereign state.

    30. One has to wonder what really is Pinoy's stance on both Sabah and Mindanao. To me its like a double edged sword, if the government successfully claims back Sabah in all likelihood the Muslims will reassert their right to it by including it in the areas for autonomy together with those already identified in Mindanao.

If you read your history well to understand the roots of the Muslim problem in Mindanao - and not just depend on TV, reports and hearsay - you will come to the realization that the Muslim cause is no different than that of the American Indians, the only distinction really is that the Bangsamoro was truly a sovereign state in its own right. Mindanao, Sulu, Palawan and North Borneo were never part of Spanish era Philippines and the Americans only got to control Mindanao, Palawan and Sulu but not North Borneo.

Think about it, if the Muslims get Sabah back they will be more emboldened to ask for true independence rather than autonomy from the Philippine government.

Will we be ready to let Mindanao, Sulu and Palawan go?

know your history and facts, the Sultan of Sulu already made several attempts during the late 1800s and 1900s to reclaim Sabah via diplomatic means (remember, Sulu was still a sovereign state back then) but the British stood pat that the contract was not a lease but a sale. even in the 1970s and 1980s the heirs of the Sultan of Sulu negotiated at least for higher payments and even a USD500M buyout but because then Pres. Marcos was preoccupied with too many things - wars with the NPA and MNLF, a looming financial and economic crisis, martial law, failing health - this was not handled well by the Philippine government.

Malaysia is one of the countries which, up to now, has refused to sign the widely ratified International Convention on Civil and Political Rights (ICCPR). This is a landmark international multilateral treaty/convention which puts the civil and political rights found in the Universal Declaration of Human Rights into a binding treaty. The Human Rights Watch, a well-known international organization, said in their 2013 World Report that:

"Malaysia is a member of the UN Human Rights Council (HRC), but has not signed or ratified most core human rights treaties. The government has also opposed including protections on the basis of sexual orientation or gender identity in the Association of Southeast Asian Nations (ASEAN) Human Rights Declaration and has blocked consideration of a comprehensive agreement to protect the rights of all migrant workers in ASEAN."

Malaysian taxi drivers are the worst in the world and if I had a choice between walking in KL or Manila at 2AM I'd take MANILA in a heartbeat.

  5. To give the ordinary layman on the street an easier picture to digest, the following analogy best describes the whole situation:

A landlord called Jamalul leased a piece of land to a tenant called Overbeck for a yearly rent of $5,000. The written agreement stated that Overbeck cannot sub-let the land or sell the lease without Jamalul’s permission.

But the tenant despite the prohibition illegally sold the lease to a sub-tenant called Great Britain who later also illegally sold the lease to a sub-sub-tenant called Malaysia.

And in between all the illegal transactions perpetrated by Overbeck, Great Britain and Malaysia, Jamalul transferred all his rights and interests to a new landlord called the Philippines. The new landlord now wants back the land but the sub-sub-tenant Malaysia refuses to leave. The new landlord wants to take the matter to the International Court of Justice at The Hague but the sub-sub-tenant Malaysia also refuses to go there.

Can the sub-sub-tenant Malaysia claim to be an innocent victim when she took over the lease from the sub-tenant Great Britain?

In my humble opinion: the law be it either international or of any civilized country is that if a purchaser acquires a property with prior knowledge that the property in question is in fact stolen or that the seller does not have a legal or legitimate title to the property at the time of transaction is equally guilty of the crime of theft. Such transaction is not only null and void and of no effect, the title to the property in question is still vested with the original owner.

The ICJ only handles cases between states and nations which must agree to come voluntarily to be adjudged and be bound by its decisions; I strongly believe that Malaysia dares not go to the International Court of Justice to face the Philippines because the former foresee the high possibility of losing.

For centuries Great Britain was the cause of a lot of world problems today, history will tell you the sufferings of people in the Middle East, Africa, Indian Sub-Continent, Argentine Falklands and many more. Even within the United Kingdom, the Scottish, Welsh, and Irish people are really pissed with England.

Hong Kong was fortunate when the late Deng Xiao Ping told Margaret Thatcher in private that if Great Britain does not leave Hong Kong after squatting there for more than 150 years, the Chinese Army will overrun Hong Kong in one day. She was eventually returned to China on July 1, 1997 and now enjoyed autonomy.

What about the voices of the population during the times of the first tenant Overbeck and sub-tenant Great Britain who agree to let the sub-sub-tenant Malaysia take over?

Let me give another analogy: I am the registered legal and legitimate owner of a bus. One day someone leased the bus from me and drove around town picking up and dropping off passengers along the way for profit. Let us say that the passengers love his driving so much that they want to patronize him for life. Does that in any way mean he can sell my bus or treat the same as his property?

To answer my earlier question: the passengers can choose to ride whichever bus they want to, but the sovereignty of Sabah is vested in the Philippines. And this also means that even if the people of Sabah today might still want to stay on with Malaysia, Sabah is still the legal and legitimate territory of the Philippines under international law if the same principles are applied as per the Judgments of the International Court of Justice with regards to the cases of Sipadan and Ligitan Islands, and Pulau Batu Puteh or Pedra Branca.

The Sultanate of Sulu had ceased to exist when every inch of its territory was ceded on Sept 12, 1962 to the government of the Philippines and as the successor-in-title of the defunct sultanate, it is entitled to reclaim Sabah which is at all material times rightfully theirs.

    1. dream on. hongkong enjoying its autonomy? says who? there has been recent and ongoing protests in hongkong and if hongkong people were to choose they would still prefer to be under british rule. falklands residents wants to be in the UK. they do not want to be bullied by argentina's president just so because she said so it is theirs. what is her basis on this? she ignores the local people, put blockades and sanctions to all their trade routes. this is all propaganda, a way to mask the real issues in argentina, with its shrinking economy and debt crisis.

it is easy to blame someone when something is wrong. yes blame the british for all the current world problems, yet they do not blame themselves for the problems they which they have caused themselves. yes blame the british for the poverty in africa, don't mind the corrupt governments there raping, pillaging, leeching the lifeblood of their countries. yes, blame the british for the indian sub-continent's problems, ignore the fact that pakistan is overrun by terrorist and corrupt officials. blame the british for all the problems in the middle east, ignore the fact that in syria it is president assad who is killing his own people, not to mention similar issues in iran, egypt and libya.

yes blame the british, who yearly spends almost 1%(£7bn) of its GDP in international developments and aids, despite its shrinking economy and being in recession.

yes you can blame someone except yourself. typical....

finally, your analogy is a joke! you are comparing a bus over a territory with over 3 million people who lived there all their lives, have their own culture, language and economy? are you insane!? you want them to leave just because you think it is yours and they are squatting? incredible!!!

  7. Classic Pinoys, discussing Sabah instead of understanding the bigger issue on hand, that is the ticking time bomb in Mindanao.

Do you guys even know your history?

Mindanao in its entirety never became part of the Spanish Philippines. The Sultanates of Maguindanao and Sulu, and various lumad barangay-kingdoms ruled it.

"Philippines" during the Spanish era included Luzon, Visayas, Marianas Islands, Palau, Caroline Islands, and tiny specks in Taiwan and Moluccas.

A Republic of Zamboanga existed as an American protectorate from 1899-1903, with elections even supervised by Americans. It was dissolved and merged into surrounding Muslim provinces as the Moro province.

Mindanao officially became part of the Philippines (in its entirety) when the Americans dissolved the Moro Province (which was ruled somewhat as a separate colony from the rest of the Philippines during 1914.

In 1935, Mindanao was then formally colonized by the Commonwealth led by Pres. Manuel Quezon.

This is the backbone of the Muslims in Mindanao, that they were never part of the Philippines to begin with, they were a sovereign state and that when Philippine independence was granted they were technically never part of it.

That is why you have the Muslim rebellion in Mindanao, because in their hearts and minds after American rule Filipinos then colonized them and that they deserve their own independence.

What a joke, Filipinos not even knowing their own history and trying to muddle into the history of others.

  8. The Bangsamoro Problem was sowed during the Spanish colonization, sprouted and took shape during the American regime and could have been aborted in 1934. The Moro leaders’ demands for redress through the three and a half decades until the grant of the Philippine Commonwealth were essentially similar to those of the Moro rebels in the 1970s until today. But the Americans and the Filipino nationalists turned blind and deaf to the Moro cry for justice and equity; they would not compromise.

During the more than 300 years of Spanish colonization, the Spanish expeditionary forces were able to drive the Moros inland, build forts but failed to conquer the Moros. The Moro warriors would always regroup and launch retaliatory attacks to confine the Spanish forces in their forts; they raided the Spanish and Christian coastal villages in the Visayas and Luzon. They remained unconquered, their sultanates ever sovereign.

Superior American military forces and their “policy of attraction” prevailed upon the Moros to give up their arms and place themselves under the American protection. However, the Americans appointed Christian Filipinos to run the courts and the local governments. They complained of injustices, inequities and prejudices. This turned worse in 1914: the Moro Province was abolished; the Moros were placed under the rule of Manila and the Filipino nationalists and subjected to Filipinization and patronage.

Besides the litany of injustices, inequities and prejudices in their petitions to the U. S. Presidents and Congresses through the Governor Generals, they strongly objected to the inclusion of Mindanao, Sulu and Palawan in the Philippine territory ceded by Spain to the United States in the Treaty of Paris. They claimed – rightly so historically – of having never been conquered by Spain. They asked to separate Mindanao, Sulu and Palawan from Luzon and the Visayas and to be independent or a U. S. Territory.

Coincidentally, the revolutionary government under Gen. Emilio Aguinaldo included Mindanao, Sulu and Palawan in the Philippine Republic. At the Malolos Constitutional Convention, these territories had delegates – not Moros but Christians. This implied that Aquinaldo and other revolutionary leaders considered Mindanao and Sulu part of the Spanish Colony like the Visayas and Luzon. It could only be asked: Did they also imply that as such the Moros were under Christian vicars? Doubly, they were wrong!

  9. In their petitions the Moros were conciliatory yet belligerent — proposing compromises for political redress but warning of troubles in the future if refused. The Americans and Filipino nationalists must have considered this as bluffs; they refused to compromise.

In the 1924 Zamboanga Petition, the Moros proposed that Mindanao, Sulu and Palawan “be made into an unorganized territory” of the U.S. To dispel any notion that the Moros “wish to dismember the Philippine Islands,” 50 years after independence has been granted to Luzon and the Visayas as the Philippine Republic, a plebiscite will be held for the Moros to decide if Mindanao, Sulu and Palawan will join the Republic, remain a U.S. territory or become independent.

In the 1934 Dansalan Petition, the Moros, after participating in the election of delegates to the Constitutional Convention – a manifestation that under satisfactory conditions they would join the independent Philippines – submitted to the Governor General, three days before the convention opened, seven proposals for inclusion in the Constitution. Three weeks after the adoption of the Constitution in 1935, they issued the Dansalan Declaration resenting the complete rejection of their Petition and warning of troubles.

The overriding issue in the 1923 and 1934 petitions was “consent” of the Moros before Mindanao, Sulu and Palawan would be included in the Philippine Republic. In the 1924, the “consent” was through a plebiscite; in the 1934, the “consent” was conditional – IF the Moro concerns and welfare would be accommodated in the Constitution. In both, the Moros were offering to compromise their demand for independence.

This fact is most enlightening: In 1934, the Moros sought redress and reconciliation by asking for constitutional accommodation; they were ignored. Today, since the 1970s, the Moro Liberation Front organizations, have been seeking redress and reconciliation through constitutional amendments; they were rebuffed – even vilified – in the MOA-AD (2008 GPH-MILF Memorandum of Agreement on Ancestral Domain). Will the FAB bring the long-sought redress and reconciliation?

  10. After the establishment of the Philippine Commonwealth, the government under the full control of the Filipinos led by President Manuel L. Quezon did not rectify the established policies and laws unjust to the Moros – especially those pertaining to lands. Instead, more laws supported the policy to develop Mindanao regardless of its adverse effects on the Moros. Mindanao was dubbed the “Land of Promise” that to the Moros meant promise not for them but for the Christians.

[NOTE: To elaborate on the point: The Philippine Commonwealth was inaugurated on November 15, 1935. Among the last acts of the Philippine Legislature was Legislative Act 4197 -- the Quirino-Recto Colonization Act – declaring the opening of settlements in Mindanao to solve the problems of the government with the Moros. Among the early laws under the Commonwealth were C.A. No. 141 “declaring all Moro ancestral landholding” not authorized by either the Spanish or American government as public lands and C.A. 441 creating the National Land Settlement Administration. The Moros saw these as “legalized land-grabbing.]

As it was in the past, Moros were appointed as heads of municipal districts and lower local government units; the Christian Filipinos as heads of municipalities and provinces in Moro areas before these were allowed to hold regular elections. In fact, President Quezon curtailed the traditional political and social powers of sultans and datus without authority from President.

The unjust laws and policies were the perpetuation of the injustices and inequities that were ignored in the Moro petitions. The anti-Moro laws and policies were manifestation of ethnic prejudice. The outcry against the MOA-AD and the adverse Decision of the Supreme Court are signs that the injustices, inequities and prejudices still dominate against the Moros.

In the 1934 Constitution, no provisions specifically protecting the Moro political, social, cultural, religious and other rights were accommodated despite the efforts of Mindanao delegates like Sultan Alaoya Alonto and Tomas Cabili. The same was true to the 1972 Constitution despite the many proposals from Moro and other Moro-friendly delegates as recounted by Delegate Datu Michael O. Mastura in his books. The 1987 Constitution is not an exception.

  11. In the 1950s, there was peace in Mindanao as there was no war. But the recurrent Moro uprisings like that of Hadji Kamlon in Sulu puzzled the government. After a three-year study starting in 1954, a House Committee must have found injustice, inequity and ethnic prejudice at the root of the Moro problem. The Moro petitions three decades past were ignored; but the grievances had continued fanning unrest.

Congress created the Commission on National Integration to integrate the Moros and other so-called cultural minorities to the mainstream Philippine society. The problems were deemed rooted in poverty and ignorance, hence the socioeconomic solutions. Like the past Filipinization policy, integration aimed to harmonize the Moros and Christians by bridging the socioeconomic and cultural gaps between them.

However, young Moro militants saw in the program the obliteration of the Moro identity. They availed of the CNI scholarship program but kept strong the political root of the Moro problem and their aspiration for independence – their only solution. Ironically, the CNI facilitated the formation of leaders of rebellion not of integration.

The CNI was dissolved in 1975, two years before the expiration of its 20-year term, as a total failure. Evidently, it was poorly managed and funded. Even at the relatively low costs prevailing at that time, how can P5 million a year support projects for meaningful change in the life of millions in Mindanao, Sulu and Palawan? And, worse! By official reports and accounts of some CNI commissioners, only about half of the annual funds were actually released. Good projects announced in media were miscarried or aborted.

  12. In 50 years from the establishment of the American rule to the creation of the CNI, the assessment of the Moro problem as rooted in ignorance and poverty had not changed; and so had socioeconomic and cultural development as the solution. And, in another 50 years from CNI to the Aquino III administration, the assessment has virtually remained unchanged. Their agreement in the recent FAB notwithstanding, this poses as a fundamental difference between the MILF and Government negotiating panels.

Almost 80 years after the Moro efforts for redress and reconciliation were blocked at the 1934 constitutional convention and 40 years after similar efforts were frustrated at the 1972 constitutional convention, Filipino national leaders and constitutionalists still block proposals to amend the Constitution to accommodate Moro demands for redress and reconciliation. While the Moros look at the Constitution as the solution, they see it as the problem in the Mindanao peace process. Can the FAB hurdle this roadblock?

Well..yeah mas pipiliin na lang nila yung mga libre at instant pera sa tv or instant gratification pag nakita na ang mga artista, they don't even bother to read anymore. This is just sad, sabi na nga ba eh, hindi talaga united itong bansa na to..I think our politicians only see the Philippines beyond the corners of Luzon and Visayas only. The vicious cycle of war in Mindanao will never truly end, they will need a dictator-esque tyrant to really pull through.

How ironic calling the Malaysians as land grabbers when truth to be told Mindanao was also "grabbed" by the then Philippine Commonwealth by virtue of the QUIRINO-RECTO COLONIZATION ACT.

classic case of the pot calling the kettle black.

  14. You want to know how STRONG are the Philippines claim on Sabah? Below are the answers:-

Oh, SO FUNNY.... I CANNOT STOP LAUGHING.....

So you wanna take Sabah away from Malaysia? Want Sabah be a part of the Philippines? Then you guys must be prepare to go to war with us, Malaysians. We will not give away Sabah, not without a fight. You have to taste your nose get bloodied very bad first before you ever think of getting Sabah out of Malaysia. So you want WAR with Malaysia?

    Oh wait...

    1) Malaysia is the only country that successfully defeat the communist insurgent in the whole wide world. Malaysia & The Philippines communist insurgents problem started about the same time, but the Philippines until now cannot defeat the NPA communist, even after more than 40 years! If Philippne Army invade Sabah, the Malaysia Army will slaughter the Philippine Army just like we slaughter the communist decades ago. Now want to claim Sabah? What a shame...

    2) Philippines Army are also facing insurgents group like MILF,MNLF & Abu Sayaf, & until now cannot even defeat one of them for decades now! Even the MILF u guys cannot beat. What a shame...

    3) Philippine Army of 120,000 soldier cannot even defeat the 500-1000 Abu Sayaf fighter! Even 500 -1000 bandits also u guys cannot beat, now what to take away Sabah from Malaysia? What a shame....

    4) Philippine Air Force don't have any operational jet fighter!!! Malaysia have 18 Mig-29, 8 F-18 & 18 Su-30, all are considered the latest & the most modern fighter aircraft in the world. All are equipped with Beyond Visual Range (BVR) missiles. Philippine Air force don't even have an operational aircraft & NO air to air missile. What a shame....

    5) Philippine Army don't have any Main Battle Tank. Malaysia have PT-91M Main Battle Tank. U guys don't even have an anti tank missile (ATM). What a shame....

    6) Phillipine Navy have only 2nd hand World War 2 era ship that was build in 1943 as it's main capital ship. Plus no surface to surface missile, only equipped with 76mm guns. Malaysia have tons of modern frigates, corvettes & Offshore Patrol ships, all equipped with the latest & modern electronic sensors & surface to surface missiles. What a shame....

    7) Philippine Navy have no submarine. Malaysia have 2 Scorpene submarines & 1 Quessant submarine. The Scorpene submarine is considered as one of the best & quitest submarine in the world with torpedo & sub-surface to surface missiles. The sub-surface missile, SM-39, can be fired underwater to target surface warship 50km away & equipped with GPS, in case want to fire at ports. Do you even have a submarine? What a shame....

There any many more I want to write, but I guess its enough for today. Your own mess inside your country also cannot handle, now want to take care of another new territory. In your dreams lah...

Remember: Malaysia have BIGGER DICK (New, Large & Modern Military Hardware) than your SMALL DICK (2nd hand, small, donated & obsolete military hardware). So just shut up & be happy with your small dick.

    1. Yes, that's true. If you ask me, I don't want to be involved in this silly war. In my opinion this issue is just so ancient it really has to die soon, everyone's getting hurt and nobody is getting the benefit from it.

Our own Philippine president is just too busy with the upcoming elections and he is too busy promoting his own "Team P-Noy" so that he could get whatever shit he wants..but yeah that won't change anything at all. I laugh at the truth you just said right there about our military(it is so archaic that if any nation wanted to take over this country they can so easily even without a fight), because that is something that the majority of people here ignore, the only thing my country is proud of is the 'misguided' "Pinoy Pride" which is I'm so ashamed of.

now the tables have really turned, we were once the best military in this region ngayon "nganga".

  15. If people are talking about claiming lands then I guess parts of China should be sent back to Mongolia, Australia should be returned to the aborigines and the 'whites' there be sent back to the UK..It's like telling the people that live in the United States of America to send 'everyone' back and give the land back to the Native Americans..

Squatting? wow, we can't even fix our own squatters in our own country..oh that's right they are voters too..so that's why it will never be fixed.

Only thing I can say is, this whole shit started when Malaysia failed to increase the amount of payment to the Sultanate of Sulu, then I guess if they increase the payment, maybe they can just go back home now whether they get put in jail or be tried in the court of law isn't our problem anymore. What's the point of having more people dying when this whole clusterfuck can't even fix itself. When our own government doesn't even give a damn about this...because if noynoy really cared it would have been a swift, decisive strike in Sabah, but no..instead he's doing the exact opposite. I guess that's what you get when you vote people who are just famous for being famous and not competent enough for the job.

FFS, as a friend of the Philippines, accept the current borders and don´t let both countries be pulled into a war nobody wants.
I personally could raise claims to land in both Lithuania and Poland, where my paternal ancestors used to own land, when the places were still part of the German empire, which they lost after WW1 and WW2 respectively. Similarly German aristocrats, who used to own large parts of land in what today is Poland, similar to your haciendas, Russia or Lithuania, lost their land due to WW2 and were, after the German re-unification, told that they will not get it back. This is history.

Imagine if a group of German Neo-Nazis would raise a private army to reconquer former German land in today´s Russia, Poland or the Czech Republic. You can be sure that the present German government, with full support of the rest of the population, would cooperate with the respective governments and, while giving the Russians, Poles etc. free hand in their lands, hunt down any supporter of a movement at home, which tried to pull our countries into a war.
I also see nothing in the Sultan´s speeches about having Sabah join the REPUBLIC of the Philippines. For him it is private property, where he can rule in absolutist, feudal manner.

What if China decided to do a Kiram on the Spratleys? Should we begrudge the Chinese if they set up shop in the Spratleys – much like what what the Filipinos are doing in Sabah today?

Will “proud Pinoys” say it’s okay for Kiram to do so, but not China?
